aforesaid on the 8th day of February A.D. 1854

Be it remembered that on this day to wit on the 8th day of February A.D. 1854, the last Will and Testament of Thomas Scott late of Brown County Ohio, deceased, was produced in open court and the court upon hearing the proof as to the due execution of the said Will did make an order in relation thereto which order is in the words and figures following to wit:

The last Will and Testament of Thomas Scott sen was this day produced in open court by G.W. King Attorney for the executors therein named, and George Mitchell and G.W. King the subscribing witnesses to said Will appeared and in open court, on oath, testified to the due execution of said Will which testimony was reduced to writing and by them respectively subscribed and filed with said Will and it appearing to the Court by said testimony that said Will was duly attested and executed and that the said Testator at the time of executing the same was of full age and of sound mind and memory and not under any restraint. It is ordered by the Court that said Will and testimony be recorded.

Whereupon Henry Martin & Leroy J. Kendall the executors in said Will named appeared in court and signified their acceptance of the trust of executing said Will. It is therefore further ordered that letters testamentary be issued to them on their giving bond in the sum of twelve thousand dollars with George Mitchell and Nathan McConnell as sureties conditioned according to law. The Court appoint James Loudon, William Kelly and Joseph Moore appraisers of the personal estate of said testator.

WILL
Know all men by these presents that I Thomas Scott Sr. of Brown County, Ohio do make and publish this my last Will and testament as follows - First I will that all my just debts and funeral expenses be fully paid by my executors herein after appointed. Second I appoint Henry Martin & Leroy Kendall executors of this my last Will, and I hereby authorize my said executors or the survivor to sell all my estate real and personal after my death and to convey by deeds or deeds in fee simple all my real estate to the purchaser or purchasers and it is my will that my said executors distribute and pay over equally share and share alike all the proceeds of my estate and personal of every kind to my children herein named, to wit: To Nancy Pikett one equal sixth part, to Matilda Moore one equal sixth part, to Elizabeth Johnston one equal sixth part, to Julian Parsons one equal sixth part, to Doshy Kendall one equal sixth part, to Thomas Scott jr. one equal sixth part.

PROOF


Probate Court Brown County, Ohio Feby 8th 1854

This day George Mitchell and G.W. King came personally into open Court and being duly sworn according to law, upon their oaths say, that we were present at the execution of the last Will and Testament of Thomas Scott Sr hereto annexed. That we saw the testator subscribe said Will by making his mark and heard him publish and declare the same to be his last Will and Testament and that said Testator at the time of the execution of the same was of full age and of sound mind and memory, and not under any restraint, and that we signed the same as witnesses at his request and in his presence and in the presence of each other,
